Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Scrabb Shopify app (the "Service"), provided by McDaniel Creative ("we," "us," "our"), available at mcdanielcreative.com/scrabb-app. By installing or using Scrabb, you ("you," the "merchant") agree to these Terms. 1. The Service
Scrabb is a whiteboard and notes app embedded in your Shopify admin. It lets the staff on your store create boards — typing and drawing to capture ideas, to-dos, and sketches. Boards are either personal (private to the staff member who created them) or shared (visible to everyone on the store).
Scrabb requests no data access scopes and does not read your orders, products, customers, or storefront. It stores only the boards your staff create and the identity of the staff members who create them, as described in our Privacy Policy.
2. Free of charge
Scrabb is provided free of charge. There is no subscription, usage fee, or paid tier. We may introduce optional paid features in the future; if we do, we will give you notice and you will never be charged for anything without your express consent. Existing free functionality described at the time you installed will remain available to you.
3. Eligibility and account
To use Scrabb you must have an active Shopify store and the authority to install apps on it. You are responsible for your Shopify account, for the staff members you grant access to, and for all activity that occurs on your boards.
4. Acceptable use
You agree not to use Scrabb to:
- Store or transmit unlawful, infringing, defamatory, or malicious content.
- Upload content that violates the privacy or intellectual-property rights of others.
- Attempt to gain unauthorized access to the Service, other merchants' data, or our infrastructure.
- Interfere with, disrupt, overload, or reverse-engineer the Service.
- Use the Service in violation of any applicable law or Shopify's terms.
We may suspend or terminate access that violates these Terms.
5. Your content
You own your boards. The text, drawings, and other content your staff create in Scrabb ("Your Content") belong to you. We claim no ownership of Your Content.
You grant us a limited license to store, process, and display Your Content solely to provide the Service to you. We do not use Your Content for advertising, analytics, profiling, or to train AI models. See our Privacy Policy for details.
You are responsible for Your Content and for keeping your own copies of anything important. While we take reasonable measures to protect and back up data, you should not rely on Scrabb as your only store of critical information.
6. Our intellectual property
The Service — including its software, design, name, and logo — is owned by McDaniel Creative and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while installed; they do not transfer any ownership in the Service to you.
7. Availability and changes
We aim to keep Scrabb available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Service at any time. If we plan to discontinue the Service entirely, we will make reasonable efforts to notify merchants in advance so you can export or preserve Your Content.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available, or that data will never be lost.
9. Limitation of liability
To the maximum extent permitted by law, McDaniel Creative will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Because Scrabb is provided free of charge, our total aggregate liability for any claim relating to the Service will not exceed USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Termination
You may stop using Scrabb at any time by uninstalling it from your Shopify admin. On uninstall, your data is deleted as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitation of liability) will survive.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, for material changes, provide notice via the app or by email to merchants. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the United States and the State of Utah, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
